MINUTES OF THE MEMBERSHIP MEETING OF
04 May 2009 Opening Ceremony: Commander Abney, called the meeting to order in proper form at 19:31 hrs on Monday, 04 May 2009, at the Post home with the POW-MIA flag being in place. Roll Call of Officers: The roll call produced a quorum. 9 Officers and 2 Executive Committee Members (ECM) answered the Roll Call. 1st Vice Commander Stennis is excused and ECM Howard is absent. The 3rd Vice Commander and the Adjutant are vacant. Reading of the Minutes: Commander Abney called for a suspension of the reading of the minutes of the prior meeting. Stan Babic moved for acceptance of the minutes as published and with a 2nd from Frank Smolinski. The motion passes. Introduction of Guests: Sergeant-at-Arms Denes introduced Jim Campbell, Keith Bell, Rick Duruttya, and Rex Buchs. 1st Vice Commander: 1st Vice Stennis is excused, but the Commander stated that we are at 100% membership for the report. 2nd Vice Commander: 2nd Vice Gladen has no report. 3rd Vice Commander: The office is vacant. Commander Abney reported that he has been working with the Buckeye Boys and Girls Youth Programs and read the names of nine boys and possibly one more. The Post is also sending ten girls. Commander Abney said that there would be a total of 920 at Boys State. The average being sent from participating posts is two. Post 336 is sending 20 youths and should be commended. There is no Color Guard Report. Dave Scott suggests Dr Smith, Lake County Coroner, as a Memorial Day speaker. Finance Officer: Finance Officer Rodecker reports for the month of April our inflow was $x,xxx with an outflow of $x,xxx.97. Our check book balance is $x,xxx.70 and he still has to deposit $x,xxx in checks is expecting another check for $x,xxx from Canteen operations. From the split money of $x,xxx the Post will get $x,xxx and the balance to Charity. Chaplain Morgan moved and Trustee Babic seconded to approve the report. Motion carried. Historian: Al Rein has no report. Service Officer: John Chebra reports one death of Marine Andrew Losterman who received the Purple Heart at Bunker Hill, during the Korean conflict. Historian Rein moved and ECM Martin seconded to approve the report. Motion carried. Chaplain: John Morgan has no report. Trustees: Commander Abney acknowledged the Trustees Report distributed before the meeting. Judge Advocate Whiting moved accept the report with a second from Historian Rein. Motion carried. Judge Advocate: Judge Advocate Whiting reported. There was a complaint filed but was withdrawn and he will make sure the paper work is filed. He mentioned that after the election Commander Hahn of Post 678 must be sent the results for Delegates and Alternate Delegates for the 9th District Convention being held on 09 & 10 MAY. Judge Whiting acknowledged the motion to accept 06 APR Membership Minutes and 20 APR Executive Committee Minutes as published. He asked everyone to go over the minutes of to make sure they are correct and corrections could be discussed in New Business. ECM Evans moved to approve Judge Advocate’s report with a second from 2nd Stan Babic. Motion carried. Pavilion Committee: Chairman Gladen had no report. Charity Committee: 1st Vice Stennis is on vacation and there is no report. Past Commander Erb extended a thank you from the Cuyahoga County Veterans Service Committee for our donation of $xxx to the Harvest for Hunger Fund. Old Business: There is no old business. Good of the Legion: Commander Abney introduced Commander Jim Campbell who has been a member of the American Legion for 13 years and is running for 2nd Vice Commander in the 9th District and is asking for our endorsement. Commander Campbell addressed the body. Commander Abney asked the SAL Advisor, Lenny Wietrzykowski, to report. He yielded the floor to Rex Buchs who mentioned that the Golf Outing is this Saturday 09 MAY and to let him know tonight if you are attending. They sold 45 tickets for the Pork Chop Dinner and made a little over $xxx. He needs to postpone the Car Show until later in the year. He asked if the Post could contribute to his fellowship room at the convention in Cincinnati. Judge Advocate Whiting moved to return to New Business and with a second from Chaplain Morgan the motion carried. New Business: Judge Advocate Whiting moved that Post 336 give a check for $xxx to the Sons of the American Legion to support Rex Buchs in his quest for 1st Vice Commander for the Detachment of Ohio. Historian Rein seconded. Motion carried. A motion was made by Trustee Dillon to pay $xxx for an exhaust fan and was seconded by Chaplain Morgan. Motion carried. Judge Advocate Whiting moved to return to the Good of the Legion and with a seconded by Chaplain Morgan the motion carried. Good of the Legion: ECM Martin reminded everyone that 16 May was Armed Forces Day. Dick Whittaker from the City of Painesville spoke regarding the Memorial Day Concert and parade changes. Stan Babic will work with the City. Finance Officer Rodecker moved to take a ten minute break and with a second from Historian Rein. Motion carried. Commander Abney reconvened the meeting. 04 MAY Election: Commander Abney yielded the chair to Past Commander Erb to conduct the Post Elections. There is one position for Trustee, three positions open Executive Committee and four Delegates and Alternates. There is one candidate nominated for Commander, Derrick Abney. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Derrick Abney as Commander. Historian Rein seconded. Motion carried. Ron Whiting, Acting Adjutant for Post 336, cast one unanimous ballot for Derrick Abney as Commander of Post 336. There is one candidate nominated for 1st Vice Commander, Charles Stennis. No other nominations were made. Judge Advocate Whiting moved that we cast one unanimous ballot for Charles Stennis as 1st Vice Commander. Chaplain Morgan seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Charles Stennis as 1st Vice Commander of Post 336. There is one candidate nominated for 2nd Vice Commander, John Morgan. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for John Morgan as 2nd Vice Commander. Jack Smith seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for John Morgan as 2nd Vice Commander of Post 336. There are no nominations for 3rd Vice Commander. Joe Man was nominated for 3rd Vice Commander. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Joe Man as 3rd Vice Commander. EMC, Mike Evans seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Joe Man as 3rd Vice Commander of Post 336. There is one candidate nominated for Finance Officer, Brian Rodecker. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Brian Rodecker as Finance Officer. John Morgan seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Brian Rodecker as Finance Officer of Post 336. There is one candidate nominated for Historian, Al Rein. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Al Rein as Historian. Larry Gladen seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Al Rein as Historian of Post 336. There is one candidate nominated for Service Officer, John Chebra. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for John Chebra as Service Officer. Lee Kelly seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for John Chebra as Service Officer of Post 336. There is one candidate nominated for Sergeant-at-Arms, Lou Denes. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Lou Denis for Sergeant-at-Arms. Lenny Wietrzykowski seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Lou Denis as Sergeant-at-Arms of Post 336. There was one candidate nominated for Chaplain, John Morgan. Since he already accepted the position of 2nd Vice Commander, the position is open. Judge Advocate Whiting, nominated Lee Kelly for Chaplain. Trustee Smith seconded. Lee Kelly accepted. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Lee Kelly for Chaplain. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Lee Kelly as Chaplain of Post 336. There is one candidate nominated for Judge Advocate, Ron Whiting. No other nominations were made. Commander Abney moved that we cast one unanimous ballot for Ron Whiting for Judge Advocate. John Morgan seconded. Motion carried. Commander Abney cast one unanimous ballot for Ron Whiting as Judge Advocate of Post 336. There are four nominations and three positions open for Executive Committee Members, Mike Evans, Ron Martin, John Howard and Ken Kapes. John Howard was absent. No other nominations were made. There will be a written ballot done. Three tellers were appointed to count the votes: Stan Babic, Lenny Wietrzykowski and Ron Clark. Judge Advocate Whiting read the duties of the Executive Committee Members. The Commander and tellers exited the room to count the votes. After returning to the meeting Commander Abney announced that the Mike Evans, Ken Kates and Ron Martin were elected as the three Executive Committee Members. Judge Advocate Whiting, moved that we cast one unanimous ballot for Mike Evans, Ken Kapes and Ron Martin were elected as the three Executive Committee Members. Motion was seconded and carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Mike Evans, Ken Kapes and Ron Martin as the three Executive Committee Members of Post 336. There is one position for Trustee and one candidate nominated, Larry Gladen. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot Larry Gladen as Trustee. Motion was seconded and carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Larry Gladen as Trustee of Post 336. There is one candidate nominated for Budget & Finance, Dave Gilmer. No other nominations were made. Ron Whiting, Judge Advocate, nominated Dave Gilmer for Budget & Finance. Judge Whiting, moved that we cast one unanimous ballot for Dave Gilmer for Budget & Finance for the three year term. John Morgan seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Dave Gilmer for Budget & Finance of Post 336. There are four candidates nominated as Delegates: Derrick Abney, Rob Erb, Al Rein and Ron Whiting. No other nominations were made. A Motion was made to cast one unanimous ballot for Derrick Abney, Rob Erb, Al Rein and Ron Whiting as Delegates. With a seconded the motion carried. One unanimous ballot was cast for Derrick Abney, Rob Erb, Al Rein and Ron Whiting as Delegates for Post 336. There are three candidates nominated for Alternate Delegates: Stan Babic, Matt Dillon and Charles Stennis. Stan Babic nominated Mike Ryan and he declined. No other nominations were made. Judge Advocate Whiting, moved that we cast one unanimous ballot for Stan Babic, Matt Dillon and Charles Stennis for Alternate Delegates. John Morgan seconded. Motion carried. Ron Whiting, Acting Adjutant, cast one unanimous ballot for Stan Babic, Matt Dillon and Charles Stennis as Alternate Delegates for Post 336. With a motion from Trustee Dillon and a second from Jack Smith, the Commander adjourns the Meeting at 21:17 hrs. The motion carried. The Commander proceeds with the observance of the ritual.
